                                        SUB: Comments on proposed interpretation of transfer policy
                                        REF:  Your draft ICM in this regard
Sir,
      First we want to convey our sincere thanks to make an attempt of proper interpretations of existing transfer policy to cater more justice as well as more transparency in the transfer issue. It was our long standing demand in the interest of staff as well as for the organization. During the discussion we have elaborately placed our suggestions in the meeting between the representatives of associations and the authority. Once again submitting below our opinion with regard to your draft ICM.                                  
 
      In the introductory paragraph unnecessary service associations are blamed to hide the dual policy, played by the authority and also the indecisiveness shown before issuing the transfer list. Any violation of policy and any act of injustice towards the staff will be strongly taken up by this association . So this para may be suitably modified.
 
1.                             Transfer should be need based only and not to be made regular in nature
 
2.            Before issuing any transfer list, a list of vacancies including the anticipatory vacancies may be circulated well in advance to make the transferee represent accordingly excluding representations from Class “C” or likely difficult stations.
 
3.            The association suggests that two half yearly transfer lists may be published and cut-off date may be fixed up keeping in view to overcome the difficulties faced by the staff member.
 
4.      Last date of submitting representation will be 60 days after publication of vacancy position. Though association may submit the proposal of transfer within 90 days after publication of vacancy position. ( Ref. Point No. 2a & 2e of draft ICM )
 
5.      Options to be submitted for at least 3 station from normal stations. The incumbents from C category / like difficult declared stations may submit representations only his choice for station/stations otherwise their retention in those stations may be allowed as per XVIII para of transfer policy. ( Ref. Point No. 2b  of draft ICM )
 
6.      One circular may be issued by advising the station to forward the representation submitted by the staff within the stipulated period to the CE office with a copy endorsing to the applicant. It is also to advise that staff may get a received copy duly sealed and signed by the office, while submitting the representation. . ( Ref. Point No. 2c of draft ICM ) 
 
7.      Rendering full tenure service in NE stations are recognized by making entries in CR and also counted for weightage in promotion as per GOI policy. Comments in para 3a may be omitted as it goes against the spirit of Government policy.
 
8.       For better man management & also for smooth running of stations, enclosing herewith a list of stations may be declared as likely difficult in category. So that staff after completion of 4 year tenure may get priority of posting like from C category stations. All out efforts may be made to categorize those stations as C category difficult station at an earliest.. (Ref. Point No  3b  of draft ICM ).
 
The following stations treated as 4 [four] years difficult station:
BIHAR:
                  1. LPTV Banka. 2. LPTV Ramnagar.3. LPTV Raxaul. 4. LPTV Siwan. 5. LPTV Bhabua. 6. LPTV Daud nagar. 7. LPTV Munger. 8. LPTV Seikhpura. 9. LPTV Nawada.
 
JHARKHAND:
                             1. LPTV Nowamundy. 2. AIR Daltanganj. 3. DDK Daltanganj. 4. LPTV Dumka. 5. LPTV Musabani. 6. LPTV  Lohardaga. 7. LPTV Gumla. 8. LPTV Godda.
 
ORISSA:

9.             For posting from normal station to normal station and from normal station to difficult stations, XXVI  point of transfer policy may be strictly followed. Though weightage may be given as far as possible for the posting at hometown . For posting apart from hometown may be done by consulting other criterion as laid down in para XXVI of transfer policy. Minimum disturbance during transfer may be attempted to as far as possible for greater reasons. A transfer representation format already circulated by CE office may be made mandatory for sending any representation. That also to be duly verified by the respective office before forwarding any transfer representation. It will be easier for consideration before any transfer posting as details of that particular staff will be readily available in the transfer representation form. ( Ref. Point No. 4  of draft ICM )
 
10.           For posting other than Hometown stations, officials who have not already been posted at a particular place will have precedence over others who already have full tenure at that place.
11. 
            If junior staff is transferred and senior in terms of station seniority may get retention on the basis of his / her appeal on sympathetic ground then he / she may not get any priority in terms of future posting unless he / she retained due to his / her own medical ground.
 
12.           Modification of transfer may be avoided as far as possible in case of transfer within the choice station. But any modification representation for the vacancies created between the two cut off dates may be allowed to consider as far as possible.  But posting beyond choice station may be modified, if possible   in the existing vacant post at that time to minimize the harassment of staff. . ( Ref. Point No5  of draft ICM )
 
13.           It may not be possible to collect NOC from both the stations by the staff in case of transfer of Helper and Technician. So present system and mutual transfer may be continued with a sympathetic view towards this low paid staff. Transferring authority has full right to allow or disallow TA / DA on merit basis. ( Ref. Point No. 3  of draft ICM )
 
14.           Staff member, having hometown at difficult station may be allowed to complete the tenure of full 4 years.
 
15.           In case of any vacancies arise after the publication of anticipatory vacancies as per DOCTEN [para N0.2] by the authority by virtue of promotions, sanction of new posts or deaths, these vacancies may be filed up while modification would be made as per options required.  
 
16.           These rules may be framed under the purview of transfer policy. In case of any doubt or confusion, transfer policy may be consulted.
 
17.           It would be implemented as objectively as possible, keeping in view the various difficulties.
 
18.           The transfer lists may be made available to the persons concerned through the station authority as a mandatory one.
 
19.           After filling up of persons from class ”C” or like wise difficult stations to a particular station, if vacancy exists, the transfer from Class-B normal stations may be considered as far as possible. 
 
 
          Hope above mentioned points will be duly considered in the greater interest. Our association is ready to extend full cooperation if the legitimate interest of the staff remains protected.
